District Attorney Hoovler Announces 20 Year Sentence in Child Rape Case

Kelvin Dubon-Rivas Previously Pled Guilty to Rape in the First Degree

Orange County District Attorney David M. Hoovler announced that on Monday, June 23, 2025, Kelvin Dubon-Rivas, age 35, of Newburgh, was sentenced before the Honorable Craig Stephen Brown in the Orange County Court to twenty (20) years in prison to be followed by twenty (20) years of post-release supervision relative to his previous guilty plea to Rape in the First Degree.  As part of the sentence, Dubon-Rivas will also be registered as a sex offender under the New York Sex Offender Registration Act (SORA).  At the plea proceedings, Dubon-Rivas admitted that in September, 2024 he engaged in anal sexual contact with an individual who was less than eleven (11) years old.

District Attorney Hoovler thanked the Town of Newburgh Police Department for their investigation which led to the arrest of the defendant.

“Stealing the innocence of a child for repulsive sexual acts is a truly hideous crime,” said District Attorney David M. Hoovler. “The lengthy sentence imposed in this case ensures that this offender will be unable to hurt others and should serve as a warning to anyone who might engage in similar conduct.  Simply put, we will not allow these crimes to go without significant punishment in Orange County.  We will continue to work with our law enforcement partners to hold sexual predatorsaccountable for their conduct.”

The case is being prosecuted by Senior Assistant District Attorney Jessica Dovico.

A criminal charge is merely an allegation by the police that a defendant has committed a violation of the criminal law, and it is not evidence of guilt. All defendants are presumed innocent and entitled to a fair trial, during which it will be the State of New York’s burden to prove guilt beyond a reasonable doubt.
