District Attorney Hoovler Announces Prison Sentence in Child Rape Case
Justin Babb Sentenced to 18 Years in Prison
Orange County District Attorney David M. Hoovler announced that on Wednesday, December 4, 2024, Justin Babb, age 41, of New Hampton, was sentenced to eighteen (18) years in state prison, and ten (10) years post-release supervision, for havingengaged in sexual conduct with a child. On May 23, 2024, Babb pled guilty in Orange County Court to Criminal Sexual Act in the First Degree. At the plea proceedings, Babb admitted that in August, 2023, he did engage in anal sexual conduct with an individual who was less than eleven (11) years old. As part of the sentence, Babb will also be registered as a sex offender under the New York Sex Offender Registration Act (SORA).
District Attorney Hoovler thanked the Orange County Child Abuse Investigation Unit for their investigation which led to the arrest of the defendant.
“Children are the most innocent of victims and this defendant’s unspeakable actions demanded a lengthy prison sentence,” said District Attorney David M. Hoovler. “It is inconceivable that a child could be subjected to the horrific acts perpetrated by this offender. I am grateful for the untiring efforts of the Orange County Child Abuse Investigation Unit and gratified that wewere able to reach a disposition involving a lengthy state prison sentence for this offender, without having to put the survivor through the additional trauma of testifying. All child and sexual abuse victims deserve our support and compassion. The children in our community will be safer while this defendant remains incarcerated.”
The case was prosecuted by Senior Assistant District Attorney Julie Mohl.
A criminal charge is merely an allegation by the police that a defendant has committed a violation of the criminal law, and it is not evidence of guilt. All defendants are presumed innocent and entitled to a fair trial, during which it will be the State of New York’s burden to prove guilt beyond a reasonable doubt.
