District Attorney Hoovler Announces Guilty Plea in Child Rape Case

Kelvin Dubon-Rivas Faces up to 20 Years in Prison

Orange County District Attorney David M. Hoovler announced that on Friday, January 31, 2025, Kelvin Dubon-Rivas, age 34, of Newburgh, pled guilty before the Honorable Craig StephenBrown in the Orange County Court to Rape in the First Degree.  At sentencing on May 20, 2025, the People will recommend that he be sentenced to twenty (20) years in prison to be followed by twenty (20) years of post-release supervision.  As part of the sentence, Dubon-Rivas will also be registered as a sex offender under the New York Sex Offender Registration Act (SORA).  At the plea proceedings, Dubon-Rivas admitted that in September, 2024 he did engage in anal sexual contact with an individual who was less than eleven (11) years old.

District Attorney Hoovler thanked the Town of Newburgh Police Department for their investigation which led to the arrest of the defendant.

“No child should ever be subjected to the repulsive acts perpetrated by this defendant,” said District Attorney David M. Hoovler. “The significant sentence this defendant faces is the only way to ensure that he is unable to harm others.  My Office, together with our law enforcement partners, will never stop seeking to hold sexual predators accountable for their conduct.  We will continue to ensure justice is served in these challenging cases.”

The case is being prosecuted by Senior Assistant District Attorney Jessica Dovico.

A criminal charge is merely an allegation by the police that a defendant has committed a violation of the criminal law, and it is not evidence of guilt. All defendants are presumed innocent and entitled to a fair trial, during which it will be the State of New York’s burden to prove guilt beyond a reasonable doubt.
